These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Customer", or "you") and Dubai Family Pass ("we", "us", "our", or "Company"), governing your access to and use of our website, mobile applications, services, and all related platforms (collectively, the "Service").

By accessing, browsing, or using any part of our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms in their entirety, you must immediately discontinue use of our Service.

Important Notice: These Terms apply to all visitors, users, and others who access or use the Service, including but not limited to customers who book tours online or buy attraction tickets through our platform.

We reserve the right to modify, update, or change these Terms at any time without prior notice. Any modifications will be effective immediately upon posting to our website. Your continued use of the Service following the posting of revised Terms constitutes your acceptance of such changes. 2. Service Description and Scope

Dubai Family Pass operates as a comprehensive online platform designed to facilitate the discovery, booking, and management of family-friendly attractions, tours, and experiences throughout Dubai and the United Arab Emirates. Our Service encompasses a wide range of offerings, including but not limited to:

  • Attraction Tickets: Access to theme parks, water parks, entertainment venues, cultural sites, and tourist attractions across Dubai
  • Tour Bookings: Desert safaris, city tours, dhow cruises, adventure activities, and guided experiences
  • Family Packages: Curated bundles of attractions and experiences designed specifically for families
  • Instant Confirmation: Real-time booking confirmation and digital ticket delivery
  • Special Promotions: Exclusive offers, including our new customer promotion of 50% off first reservations when booked within one hour

While we strive to provide accurate, up-to-date information about all attractions and services listed on our platform, we act as an intermediary between customers and third-party service providers. The actual delivery of services, attractions, and experiences is performed by independent operators, venues, and partners. Dubai Family Pass facilitates bookings but does not directly operate the attractions or tours unless explicitly stated otherwise.

2.1 Service Availability

Our Service is available 24 hours a day, 7 days a week, subject to scheduled maintenance and unforeseen technical issues. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, for any reason including but not limited to maintenance, updates, or business decisions.

3. User Accounts and Registration

To access certain features of our Service, including the ability to book tours online and buy attraction tickets, you may be required to create a user account. When creating an account, you agree to provide accurate, current, and complete information about yourself as prompted by our registration form.

3.1 Account Security and Responsibility

You are solely responsible for maintaining the confidentiality of your account credentials, including your username and password. You agree to:

  1. Immediately notify us of any unauthorized use of your account or any other breach of security
  2. Ensure that you log out from your account at the end of each session
  3. Accept responsibility for all activities that occur under your account
  4. Not share your account credentials with any third party
  5. Use a strong, unique password that is not used for other online services

Dubai Family Pass cannot and will not be liable for any loss or damage arising from your failure to comply with these security obligations. You acknowledge that we may suspend or terminate your account if we suspect any unauthorized use or security breach.

3.2 Account Eligibility

To create an account and use our Service, you must be at least 18 years of age or the age of legal majority in your jurisdiction, whichever is greater. By creating an account, you represent and warrant that you meet these age requirements and have the legal capacity to enter into these Terms.

4. Booking and Reservation Policies

When you book tours online or buy attraction tickets through Dubai Family Pass, you enter into a binding contract with both our platform and the third-party service provider. All bookings are subject to availability and confirmation.

4.1 Booking Process

The booking process involves the following steps:

  1. Selection: Choose your desired attraction, tour, or experience from our catalog
  2. Date and Time: Select your preferred date, time slot, and number of participants
  3. Personal Information: Provide required details including names, contact information, and any special requirements
  4. Payment: Complete payment using one of our accepted payment methods
  5. Confirmation: Receive instant confirmation via email with your booking details and digital tickets

4.2 Pricing and Payment

All prices displayed on our platform are in UAE Dirhams (AED) unless otherwise specified. Prices include applicable taxes and fees unless stated otherwise. We reserve the right to change prices at any time without prior notice, but price changes will not affect bookings that have already been confirmed and paid for.

Special Offer: New customers are eligible for 50% off their first reservation when booked within one hour of account creation. This promotional offer is subject to terms and conditions, including minimum purchase requirements and exclusions on certain premium experiences.

Payment must be made in full at the time of booking. We accept major credit cards, debit cards, and other payment methods as displayed during the checkout process. All payment transactions are processed securely through encrypted payment gateways.

4.3 Booking Confirmation

Upon successful completion of your booking and payment, you will receive an email confirmation containing your booking reference number, ticket details, and instructions for redemption. This confirmation serves as proof of your reservation. You must present this confirmation (either printed or on a mobile device) at the attraction or tour meeting point.

It is your responsibility to ensure that the email address provided during booking is accurate and that you can receive our confirmation emails. Please check your spam or junk folder if you do not receive confirmation within 15 minutes of booking.

5. Cancellation and Refund Policy

We understand that plans can change, and we strive to provide flexible cancellation options whenever possible. However, cancellation and refund policies vary depending on the specific attraction, tour, or service provider.

5.1 Standard Cancellation Terms

Unless otherwise specified for a particular booking:

  • Full Refund: Cancellations made more than 48 hours before the scheduled experience are eligible for a full refund
  • Partial Refund: Cancellations made between 24-48 hours before the scheduled experience may receive a 50% refund
  • No Refund: Cancellations made less than 24 hours before the scheduled experience are generally non-refundable
  • No-Show: Failure to appear at the scheduled time without prior cancellation results in forfeiture of the full booking amount

5.2 Special Circumstances

Some attractions and experiences may have different cancellation policies due to their nature, limited availability, or special arrangements. These specific policies will be clearly displayed during the booking process and in your confirmation email. Premium experiences, private tours, and special events may have stricter cancellation terms.

5.3 Refund Processing

Approved refunds will be processed within 7-14 business days and will be credited to the original payment method used for the booking. Please note that depending on your financial institution, it may take additional time for the refund to appear in your account.

5.4 Force Majeure and Extraordinary Circumstances

In cases of extreme weather conditions, natural disasters, government restrictions, or other circumstances beyond our control that result in the cancellation of an attraction or tour, we will work with you to reschedule your booking or provide a full refund at your discretion.

6. User Conduct and Prohibited Activities

By using our Service, you agree to conduct yourself in a lawful and respectful manner. You agree not to engage in any of the following prohibited activities:

  • Violating any local, national, or international laws or regulations
  • Infringing upon the intellectual property rights of Dubai Family Pass or any third party
  • Transmitting any harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable content
  • Attempting to gain unauthorized access to our systems, servers, or networks
  • Interfering with or disrupting the Service or servers connected to the Service
  • Using automated systems, bots, or scripts to access or interact with the Service
  • Impersonating any person or entity or falsely stating or misrepresenting your affiliation with any person or entity
  • Collecting or harvesting any personally identifiable information from the Service
  • Using the Service for any commercial purpose without our express written consent
  • Posting or transmitting any unsolicited advertising, promotional materials, or spam
  • Attempting to manipulate or abuse our promotional offers, including the new customer discount
  • Creating multiple accounts to circumvent restrictions or abuse promotions

We reserve the right to investigate and take appropriate legal action against anyone who violates these Terms, including but not limited to removing content, suspending or terminating accounts, and reporting violations to law enforcement authorities.

7. Intellectual Property Rights

All content, features, and functionality available through our Service, including but not limited to text, graphics, logos, images, photographs, videos, audio clips, digital downloads, data compilations, software, and the compilation thereof (collectively, "Content"), are the exclusive property of Dubai Family Pass or our licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.1 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial use. This license does not include any right to:

  • Modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any Content obtained from the Service
  • Use any data mining, robots, scraping, or similar data gathering or extraction methods
  • Download (other than page caching) any portion of the Service or any Content, except as expressly permitted by us

7.2 Trademarks

The Dubai Family Pass name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Dubai Family Pass or its affiliates. You may not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans mentioned on the Service are the trademarks of their respective owners.

8. Third-Party Services and Links

Our Service may contain links to third-party websites, services, or resources that are not owned or controlled by Dubai Family Pass. These links are provided for your convenience and information only. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

When you book tours online or buy attraction tickets through our platform, you may be interacting with third-party service providers who operate the actual attractions and experiences. While we carefully select our partners and strive to work only with reputable providers, we do not endorse, warrant, or guarantee the quality, safety, or legality of their services.

You acknowledge and agree that Dubai Family Pass shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any third-party content, goods, or services available through such websites or services.

9. Disclaimers and Limitations of Liability

9.1 Service Provided "As Is"

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. Dubai Family Pass does not warrant that:

  • The Service will function uninterrupted, secure, or available at any particular time or location
  • Any errors or defects will be corrected
  • The Service is free of viruses or other harmful components
  • The results of using the Service will meet your requirements
  • The accuracy, reliability, or completeness of any content or information obtained through the Service

9.2 Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Dubai Family Pass, its affiliates, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content
  • Statements or conduct of any third party on the Service
  • Any experiences, attractions, or tours booked through our platform

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid to Dubai Family Pass in the twelve (12) months preceding the claim, or one hundred UAE Dirhams (AED 100), whichever is greater.

9.3 Assumption of Risk

You acknowledge that certain activities, attractions, and experiences available through our Service may involve inherent risks, including but not limited to physical injury, property damage, or other harm. By booking such activities, you voluntarily assume all risks associated with participation and agree to release Dubai Family Pass from any liability related to such risks.

10. Indemnification

You agree to defend, indemnify, and hold harmless Dubai Family Pass, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms
  • Your use of the Service, including but not limited to your User Content
  • Your violation of any rights of another party
  • Your violation of any applicable laws, rules, or regulations
  • Your participation in any attractions, tours, or experiences booked through our Service

This indemnification obligation will survive the termination of these Terms and your use of the Service.

11. Dispute Resolution and Governing Law

11.1 Governing Law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of the United Arab Emirates and the Emirate of Dubai, without regard to its conflict of law provisions.

11.2 Jurisdiction

You agree that any legal action or proceeding arising out of or relating to these Terms or the Service shall be instituted exclusively in the courts of Dubai, United Arab Emirates. You irrevocably submit to the exclusive jurisdiction of such courts and waive any objection to proceedings in such courts on the grounds of venue or on the grounds that proceedings have been brought in an inconvenient forum.

11.3 Informal Resolution

Before filing any formal legal action, you agree to first contact us and attempt to resolve any dispute informally. We are committed to working with our customers to reach a fair and equitable resolution to any concerns or complaints.

12. Privacy and Data Protection

By using our Service, you consent to our collection and use of your personal information as described in the Privacy Policy.

13. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice or liability, for any reason, including but not limited to:

  • Requests by law enforcement or government agencies
  • Discontinuation or material modification of the Service

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You may terminate your account at any time by contacting our customer support team. Upon termination by you, we will deactivate your account, but certain information may be retained in our records as required by law or for legitimate business purposes.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the Service, constitute the entire agreement between you and Dubai Family Pass regarding the use of the Service and supersede all prior or contemporaneous understandings and agreements, whether written or oral.

14.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its intent, or if such modification is not possible, such provision shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

14.3 Waiver

No waiver by Dubai Family Pass of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms or any rights or obligations hereunder, by operation of law or otherwise, without our prior written consent. We may assign these Terms or any rights hereunder without your consent. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties and their respective successors and permitted assigns.

14.5 Force Majeure

Dubai Family Pass shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

14.6 Language

These Terms are written in English. Any translations provided are for convenience only. In the event of any conflict between the English version and any translation, the English version shall prevail.

15. Updates and Modifications

We reserve the right to modify, update, or replace these Terms at any time at our sole discretion. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last Updated" date at the top of this document. For significant changes, we may also provide additional notice such as email notification or a prominent notice on our homepage.

Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page periodically so you are aware of any changes. If you do not agree to the modified Terms, you must stop using the Service.
